Terms and Conditions
These Terms and Conditions (hereinafter, the "Terms and Conditions" or the "Agreement") govern access to and use of the website https://www.innolegals.com (hereinafter, the "Website" or the "PORTAL"), owned by InnoLegals Tech SL, Tax ID B56500838, with registered office at C/ Ferraz 2, 2º Izq., 28008 Madrid, Spain (hereinafter, the "OWNER" or the "PROPRIETOR"). You may contact the OWNER by sending an email to the following address: support@innolegals.com.
Access to and/or use of the Website confers the status of user (hereinafter, the "USER" or the "USERS").
Any USER who wishes to access or use the site or the services offered on it may do so subject to these TERMS AND CONDITIONS, as well as the policies and principles incorporated herein. By accessing or using the PORTAL, the USER is deemed to have accepted and agreed to comply with these TERMS AND CONDITIONS. Anyone who does not accept these TERMS AND CONDITIONS must refrain from using the PORTAL and/or acquiring the products or services offered on it.
I. PURPOSE AND AVAILABILITY
The purpose of these TERMS AND CONDITIONS is to regulate access to and use of the PORTAL, through which the OWNER offers USERS visa processing services and other legal procedures (hereinafter, the "Services").
The OWNER reserves the right to modify, at any time and without prior notice, the presentation, contents, products, services, features, and configuration of the PORTAL. Consequently, the USER acknowledges and agrees that the OWNER may interrupt, disable, or cancel any of the elements that make up the PORTAL or access to them at any time.
II. OPERATION OF THE SERVICES
USERS interested in contracting any of the Services may contact the OWNER through the Website.
Requesting or purchasing a service through the PORTAL does not necessarily imply automatic acceptance of the USER's request by the OWNER. All related services, particularly those connected to visa processing or other legal procedures, are subject to an eligibility verification. If the USER does not meet the necessary requirements for the corresponding application, their request may be automatically rejected without this generating any liability for the OWNER.
In the event the request is accepted, the USER must sign the specific terms that govern the contracting of the requested Services (hereinafter, the "Specific Terms"), which will be provided by the OWNER for the contracting of the Services.
The purchase of Services through the PORTAL does not in any case guarantee the issuance of a visa or the success of the requested procedures. The USER acknowledges and accepts the risk that the application may be denied by the competent authorities at the time of purchase.
III. USER CONDUCT
Access to or use of the PORTAL grants the status of USER of the PORTAL. This status subjects the USER to these TERMS AND CONDITIONS and to any subsequent amendments, without prejudice to applicable laws. Therefore, these TERMS AND CONDITIONS shall be deemed accepted from the moment the USER accesses the PORTAL. Given the importance of this, USERS are advised to regularly review any updates to these TERMS AND CONDITIONS.
The USER must be at least 18 years of age to use the PORTAL and the services it offers. By accessing the PORTAL and accepting these TERMS AND CONDITIONS, the USER declares and warrants that they are at least 18 years old. If underage, the account must be created and actions taken by a responsible adult on their behalf.
The USER is responsible for using the PORTAL in accordance with its intended purpose. Therefore, the use of any software to automate interactions or download content or services provided through the PORTAL is prohibited. In addition, the USER agrees to use the information, content, products, or services offered through the PORTAL in a lawful manner, without violating these TERMS AND CONDITIONS, public morals, or public order, and shall refrain from taking any action that may damage the rights of third parties or impair the operation of the PORTAL.
Likewise, the USER agrees to provide accurate and lawful information in the forms available on the PORTAL, when certain data or information is required to access some of the content, products, or services offered through the PORTAL. In any case, the USER must immediately notify the OWNER of any incident suggesting the misuse of the information provided in said forms, such as theft, loss, or unauthorized access to accounts and/or passwords.
The USER may contact the OWNER at any time to request clarifications, comments, questions, and/or suggestions related to the content, products, or services on the PORTAL and/or these TERMS AND CONDITIONS, using the contact information available on the PORTAL.
IV. USER ACCOUNT
The Website offers USERS the possibility of creating an account through an online form that must be completed with the required information.
USERS are fully responsible for the use of their User account. Consequently, USERS are responsible for properly safeguarding and maintaining the confidentiality of their USERNAME and/or passwords that allow them to access their account, and they agree not to transfer their use to third parties, either temporarily or permanently, nor to allow third-party access to them.
As a result, USERS must immediately notify the OWNER by email at support@innolegals.com of any misuse of their USERNAME and/or password, due to circumstances such as theft, loss, or unauthorized access, so that the OWNER may proceed with blocking, and/or deactivation of the User account as soon as it becomes aware of such misuse. Until such incidents are reported, the OWNER shall be exempt from any liability that may arise from the misuse of USERNAMES or passwords by unauthorized third parties.
V. DISCLAIMER OF LIABILITY
The OWNER does not in any way guarantee the continuity or availability of the content, products, or services offered through the PORTAL. However, the OWNER will take all reasonable actions within its reach to maintain the proper functioning of the PORTAL, without this implying any liability on the part of the OWNER.
Likewise, the OWNER shall not be held responsible, nor does it guarantee, that the content or software accessible through the PORTAL is free from errors, malicious software, or that it will not cause damage to the software or hardware of the USER's device used to access the PORTAL.
The OWNER shall also not be responsible for any damages that may arise from the misuse of the PORTAL. Under no circumstances shall the OWNER be liable for losses, damages, or harm of any kind that arise solely from access to or use of the PORTAL.
VI. LINK POLICY
The PORTAL may contain links, functionalities, content, or services from other websites owned and/or operated by third parties, such as, but not limited to, images, videos, comments, search engines, among others.
The use of these links, functionalities, content, or services is intended to enhance the USER's experience when using the PORTAL and does not imply any suggestion, recommendation, or invitation to use external sites. The OWNER will not review or monitor the content of external sites under any circumstances. Likewise, the OWNER does not adopt as its own any of the content, products, services, or other material present on the linked sites; therefore, the OWNER does not guarantee the availability, accuracy, truthfulness, validity, or legality of external sites accessible through the PORTAL. Moreover, the OWNER will not assume any responsibility for damages that may result from accessing or using the content, products, or services available on websites not managed by the OWNER, which may be accessible through the PORTAL.
Any USER or third party who creates or publishes a web link from an external site to this PORTAL must take into account the following:
- Reproduction (total or partial) of the contents, products, or services available on the PORTAL is not permitted without the express authorization of the OWNER. False, inaccurate, or incorrect statements about the PORTAL or its content, products, or services are also not permitted. The OWNER may restrict access to the PORTAL to individuals who engage in such actions.
- Establishing a link to the PORTAL from any external website does not imply the existence of a relationship between the OWNER and the owner of the website from which the link is made, nor does it imply the OWNER's knowledge of the content, products, or services offered on the external sites from which access to the PORTAL may be possible.
VII. PAYMENT AND BILLING POLICY
The USER may pay the corresponding amount for the contracted Services through the payment methods accepted on the Website: the Stripe payment gateway or by bank transfer.
If using the Stripe service, which is a third-party banking service, the USER understands that, despite contracting with said partner, the OWNER remains a third party in relation to the direct contractual relationship between Stripe and the USER. If the USER wishes to access Stripe's Terms and Conditions or Privacy Policy, they must visit Stripe's website or request them directly from Stripe.
User must pay all fees or charges to the account according to the rates, charges, and billing terms in effect at the time the charge is due and payable.
If the purchase constitutes a high-risk transaction, OWNER may require you to provide a copy of a government-issued photo ID and possibly a copy of a recent bank statement for the credit or debit card used in the purchase. We reserve the right to change the prices of the Services at any time.
We also reserve the right to reject any service request you make with us. If we make a change to or cancel a service, we will notify you of the terms of the change or cancellation by contacting the email address and/or billing address/phone number provided at the time the order was placed.
VIII. Refund Policy
At InnoLegals, all our services are tailored to meet the specific needs of each USER. This means we provide personalized attention from the very beginning, dedicating time and resources to prepare each case individually.
In accordance with Royal Legislative Decree 1/2007, personalized services are exempt from the right of withdrawal. For this reason, we are unable to offer refunds once the service has been paid. If you have any questions or need further information about this policy, we'll be happy to assist you. Please feel free to contact us at support@innolegals.com.
IX. INTELLECTUAL AND INDUSTRIAL PROPERTY POLICY
The OWNER, either personally or as an assignee, holds all intellectual and industrial property rights of the PORTAL, including the source code that enables its operation, as well as images, audio or video files, logos, registered trademarks, color combinations, structures, designs, and other elements that distinguish it. Therefore, these are protected by current intellectual and industrial property laws, as well as applicable international treaties. As a result, the reproduction, distribution, or dissemination of the PORTAL's contents for commercial purposes, in any format or by any means, is expressly prohibited without the prior authorization of the OWNER.
The USER agrees to respect the OWNER's intellectual and industrial property rights. However, in addition to viewing the elements of the PORTAL, the USER may print, copy, or store them provided that it is solely for personal and strictly private use.
Furthermore, the USER agrees not to delete, alter, or manipulate any element, file, or content of the PORTAL, and under no circumstances will perform actions aimed at compromising the security of protected files or databases, whether access is restricted by username and password, or because the USER does not have the necessary permissions to view, edit, or handle them.
If the USER or any third party considers that any content on the PORTAL infringes intellectual or industrial property rights, they must notify the OWNER immediately using the contact details provided on the PORTAL.
X. MODIFICATIONS
The HOLDER reserves the right to update and modify the Terms and Conditions of use without prior notice. The updated version will always be available on the HOLDER's website.
Any new features that may be added to the Services will be subject to these Terms and Conditions. Continued use of the Service by the USER after any modifications implies acceptance of such changes. The most recent version of the Terms can always be consulted on the HOLDER's Website.
XI. SEVERABILITY CLAUSE
All clauses or sections of these TERMS AND CONDITIONS must be interpreted independently and autonomously. Therefore, if any of them is declared null or invalid by a final court judgment or arbitration ruling, the remaining provisions shall not be affected. The affected clause or clauses will be replaced by others that preserve the intended effects of the TERMS AND CONDITIONS.
If the USER has any complaints regarding the services provided through this Website, they may contact the HOLDER at any time using the following contact email: support@innolegals.com
